THE 肯尼斯音乐 TERMS AND CONDITIONS OF SALE

这些销售条款和条件(“Terms of 特卖”) apply to the purchase and shipping of Goods through our Website. Please read these 销售条款 carefully before placing an Order. By confirming that 您 have read and accepted these 销售条款 when 您 submit an Order through the Website, 您 confirm 您r unconditional acceptance of these 销售条款.

However we do not warrant or guarantee that there will be no errors in the description and/or pricing of the Goods. We reserve the right, at any time and without notice, to modify the information about Goods displayed on our Website, including without limitation information on prices, description and availability of Goods. However, changes to price, availability or description of any Goods will not affect Orders submitted by 您 which have already been accepted by us in accordance with Clause 2 below. 
The foregoing will not affect 您r statutory rights relating to misdescribed goods. For more information about 您r statutory rights contact 您r local authority Trading Standards Department or Citizens Advice bureau.

To place an Order 您 will have to select the Goods on the Website, select 您r preferred shipping method and, at 您r discretion, other optional services and click on the “PLACE ORDER” button.

When 您 place an Order 您 make an offer to us to purchase the Goods 您 have selected. Orders are subject to availability and acceptance by us and we may, at any time and at our sole discretion, refuse to accept 您r Order, including but not limited to the cases where:

We will not be liable to 您 or any third party for withdrawing any Goods from the Website, removing or editing any materials or content on the Website.

If 您 have placed the Order through the Website 您 will receive an e-mail confirming receipt of 您r Order, containing the relevant details of 您r Order (such as quantities, price, shipping terms). Please note that this e-mail does NOT constitute an acceptance of 您r Order. Unless 您 cancel 您r Order, 您r Order will be accepted and the contract between us and 您 will be concluded only when we dispatch the Goods. At such time 您 will receive an Order Shipment Confirmation e-mail informing 您 that we have dispatched all, or a part, of the Goods covered by 您r Order. 
Orders can be modified or cancelled at any time before being processed by us. If 您 wish to modify or cancel 您r Order please contact us using the contact information in the 联系我们 section. We will not accept orders cancellation made in any way other than that listed above. Once 您r Order has been processed 您 may only exercise 您r right of withdrawal according to the procedure under Clause 9 below.

4.    OUR PRICING POLICY

The prices of the Goods are indicated on our Website and will be confirmed in the Order Confirmation we will send to 您 via e-mail.

If we find an error in the price of Goods 您 have ordered, we will inform 您 as soon as possible by e-mail or telephone and we will offer 您 the option of reconfirming 您r Order at the correct price or cancelling 您r Order. If 您 cancel the Order, we will refund or re-credit 您 for any sum that has been paid by 您.


5.    HOW CAN I PAY

You may pay for 您r Goods by credit or debit card, via 网上金融, or via PayPal. We accept most major payment cards, like, Maestro, Solo, Visa, Master Card and American Express. Payment must be made in the currency as indicated on 您r Order before 您 submit it.
If 您 pay by credit or debit card, 您 must supply 您r card details when 您 place 您r Order. Your credit or debit card will be debited for the total value of 您r Order at the time 您r Order is received by us. We will not accept 您r Order, neither will we supply the Goods to 您 until 您r credit or debit card issuer has authorised the use of 您r card for payment of the Goods ordered. If we do not receive such authorisation we will notify 您. We reserve the right to verify the identity of the credit or debit card holder by requesting appropriate documentation.

If 您 are paying by PayPal 您 will be asked to log in to 您r account with 您r email address and password to confirm the payment. If 您 do not have a PayPal account 您 can still pay with PayPal up to a maximum of 10 times and will be asked to enter personal data and credit card details. Your Goods will be supplied after 您r payment is cleared. If we do not receive payment in cleared funds within 30 days after the date of 您r Order then 您r Order will be cancelled. 
We will send the Goods to 您 at the delivery address indicated on 您r Order Confirmation. We may, however, only send documents by e-mail to the e-mail address which 您 provided at the time of making the Order.
If 您 are paying by Finance, 您 will be asked which repayment plan 您 wish to apply to 您r order at the checkout, and 您 will then be taken to a secure Finance application form hosted by V12 Retail Finance. Upon successful completion of a Finance application, 您 will be redirected back to our website and 您 will receive an Order Confirmation email.

Delivery will be made by our express courier (DPD) working days as standard, unless specific time/day slots are opted for at the checkout. Upon delivery of the Goods to our carrier we will send 您 an Order Shipment Confirmation email.

7.    HOW TO RETURN GOODS

If 您 wish to return for a refund any Goods which were supplied in error, were incomplete, damaged or faulty, or in the event that 您 exercise 您r right of withdrawal pursuant to Clause 8 below, 您 can do so by:
1.   If 您 have received the Goods as a gift 您 must provide an e-mail address, or alternatively Goods may be returned by the original purchaser.

It is 您r responsibility to obtain proof that the Goods have been returned, by returning the items by registered post or by such other means which gives proof of date of postage and delivery. We recommend that 您 return the Goods by means which allow 您 to track their return and which insures 您 for the value of the Goods. We do not accept liability for Goods which are damaged or lost during the shipment to us;
3.    Before returning any Goods to us please check that 您 have:

(iii)    Include 您r Order Confirmation or other proof of purchase (unless 您 are returning a gift);

4.    You will be notified by email once 您r return has been received and processed. Where 您 have received the Goods as a gift we will contact 您 using the email address given at the time of return or where this has not been provided notification will be sent to the original purchaser. 

Please also note that we will not process 您r refund until we receive the Goods. Once we receive the Goods, we will:
(一世)    Examine the Goods 您 have returned to us to verify whether they are faulty, damaged or if they do not correspond to their description on the Website;
(ii)    At 您r option where the Goods are faulty, damaged or if they do not correspond to their description on the Website: (一世) repair the Goods or replace them with new non-faulty or corresponding Goods; or, (ii) refund the price paid for the Goods (along with the original delivery fees). Save that where 您 have requested, and we are unable to, repair or replace the Goods, we will refund the price paid for the Goods (along with the original delivery fees);

8.    您的提款权 

If 您 have received the ordered Goods and are not satisfied with any of them or have simply changed 您r mind about purchasing them after we have e-mailed 您 您r Order Confirmation, 您 may exercise 您r right of withdrawal without penalty and without giving any reason and request a refund, pursuant to The UK Consumer Protection (Distance Selling) Regulations 2000 provided that:
(一世)    You inform us of 您r decision to cancel the contract within 14 (fourteen) working days of delivery of the Goods, in writing by hand or registered letter, e-mail or telephone, provided that if 您 notify us by e-mail or telephone 您 confirm 您r decision by registered letter with return receipt, at the following address:

9.    我们无法控制的情况

We will inform 您 of any such unforeseen event as soon as possible after its occurrence and we will perform our obligations as soon as reasonably possible. Should this interruption continue beyond a period of 2 (two) weeks, 您 will be entitled to cancel the Order, and a refund will be made in accordance with Clause 8 of these 销售条款.


10。    APPLICABLE LAW

These 销售条款 are governed by the law of Scotland without regard to its conflicts of laws provisions. To the extent this is permitted by the applicable laws on consumer protection, any action or claim related to these 销售条款 shall be submitted to the exclusive jurisdiction of the courts of Scotland.

12    GENERAL TERMS

Neither our failure nor 您r failure to enforce any term of these 销售条款 constitutes a waiver of such term. Such failure shall in no way affect the right later to enforce such term.


13    DEFINITION

。 “合同” means the contract between 您 and us for the sale and purchase of Goods, comprising 您r Order, our Order Confirmation of 您r Order and these 销售条款;
